Terms of Service
Effective September 14, 2026.
These Terms of Service (“Terms”) govern your access to and use of drifted.nyc (“Drifted,” “we,” “us”). By creating an account, browsing listings, or otherwise using Drifted, you agree to these Terms. If you don’t agree, don’t use Drifted.
1 — Eligibility
You must be at least 18 years old to create an account or use Drifted. By confirming your age during signup, you represent that you meet this requirement.
2 — What Drifted Is — and Isn’t
Drifted is a classifieds board and trust layer for buying, selling, and registering bikes in New York City. We connect buyers and sellers; we are not a party to any sale, we do not process payment for peer-to-peer transactions, and we do not hold, escrow, or guarantee any money exchanged between users. Payment between a buyer and seller (cash, Zelle, Venmo, or otherwise) is arranged entirely between them, at their own risk.
Drifted does not verify the identity of any user, the ownership of any item listed, or the accuracy of any listing, review, or profile. “Serial checked” and similar badges reflect an automated lookup only, not a guarantee that an item is not stolen or that a seller owns it. You are responsible for evaluating who you deal with and what you buy.
The only payment Drifted itself processes is an optional paid promotion (featuring or bumping a listing), handled through Stripe. That fee is for visibility only and has no bearing on whether a sale happens.
3 — Your Account
You’re responsible for your account and everything that happens under it. Keep your login secure, and give us accurate information — your display name, location (borough/neighborhood only; your exact address is never shown), and anything else you add to your profile or listings.
4 — Meeting in Person
Drifted facilitates in-person meetups between strangers to exchange goods and money. This carries real risk that Drifted cannot eliminate or control. You are solely responsible for your own safety. We strongly recommend meeting in a public place, bringing a friend, inspecting an item before paying, and never sharing financial or personal information you wouldn’t give a stranger. Drifted is not responsible for what happens at a meetup arranged through the platform.
5 — Conduct and Content
You agree not to use Drifted to:
- List a stolen item, or one you don’t have the right to sell;
- Post false, misleading, or fraudulent listings, reviews, or profile information;
- Harass, threaten, or discriminate against another user;
- Circumvent moderation, suspension, or the reporting system;
- Scrape, resell, or repurpose Drifted’s data or listings; or
- Use Drifted for anything illegal.
You keep ownership of what you post (photos, listing text, bio, messages, reviews), but you grant Drifted a license to host, display, and distribute it as part of operating the service — including in a public listing, a shareable Bike Card, or an Open Graph preview.
6 — Reviews
Reviews must reflect a real, completed transaction on Drifted. Fake, retaliatory, or paid-for reviews may be removed, and the account that posted them may be suspended.
7 — Moderation, Suspension, and Termination
We may remove content, hide a listing, or suspend or terminate an account — with or without notice — for violating these Terms, in response to a report, or at our discretion to keep Drifted safe and usable. You can stop using Drifted at any time; account deletion can be requested by replying to the email tied to your account.
8 — Disclaimers
Drifted is provided “as is” and “as available,” without warranties of any kind, express or implied — including any warranty that listings are accurate, that a user is who they claim to be, or that the service will be uninterrupted or error-free.
9 — Limitation of Liability
To the fullest extent permitted by law, Drifted and its operator are not liable for any indirect, incidental, or consequential damages, or for any dispute, loss, injury, or damage arising from a transaction, meetup, or interaction between users — even if we’ve been advised of the possibility. Our total liability for any claim relating to Drifted is limited to the amount (if any) you paid us in the 12 months before the claim arose.
10 — Indemnification
You agree to indemnify and hold Drifted harmless from any claim or demand — including reasonable legal fees — arising out of your use of Drifted, your listings or content, or your dealings with another user.
11 — Dispute Resolution
Any dispute arising from these Terms or your use of Drifted will be resolved through binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court. You and Drifted each waive the right to a jury trial and to participate in a class action.
12 — Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules.
13 — Changes to These Terms
We may update these Terms from time to time. If we make a material change, we’ll update the effective date above. Continuing to use Drifted after a change means you accept the updated Terms.
